The Indian legal system's delays stem from a severe shortage of judges. India has approximately 22 judges per million people, far below the Law Commission's recommendation of 50. As of December 1, 2025, 4,855 judicial officer posts were vacant in district and subordinate courts.

This shortage contributes to a backlog of over 54 million pending cases nationwide, including more than 180,000 cases pending for over 30 years. The vacancies and low judge strength directly limit the number of cases that can be decided, causing systemic delays.
